1 \u2013 By browsing this area, the user accesses posa pro, available at the URL https:\/\/www.posapro.it. Browsing the site and submitting a purchase order on it imply acceptance of the Terms and of the Data Protection Policies adopted by the site and set out herein.<\/span><\/h5>

2 \u2013 These General Terms and Conditions of Sale apply to the sale of products exclusively with reference to purchases made on the site in accordance with Part III, Title III, Chapter I of the Consumer Code (Legislative Decree no. 206\/05 as amended by Legislative Decree no. 21\/14 and Legislative Decree 70\/03) by<\/span><\/h5>

Art. 2 \u2013 Subject matter<\/span><\/h5>

1 – <\/span>These General Terms and Conditions of Sale govern the offer, submission and acceptance of purchase orders for products on posa pro. They do not govern the supply of services or the sale of products by parties other than the seller that appear on the same site via links, banners or other hyperlinks.<\/span><\/h5>

2 – <\/span>Before submitting orders and purchasing products and services from other parties, we recommend checking their terms of sale.<\/span><\/h5>

Art. 3 \u2013 Conclusion of the contract<\/span><\/h5>

1 – <\/span>To conclude the purchase contract, you must complete the electronic order form and submit it following the relevant instructions.<\/span><\/h5>

2 – <\/span>The form contains a reference to the General Terms and Conditions of Sale, images of each product and its price, the available payment methods, delivery methods for the purchased products and the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal, and the methods and timescales for returning purchased products.<\/span><\/h5>
\u00a0<\/h5>
3 – <\/span>Before concluding the contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale, including the information on the right of withdrawal and on the processing of personal data.<\/span><\/h5>

4 – <\/span>The contract is concluded when the seller receives the order form completed by the user, after checking that the data contained therein are correct.<\/span><\/h5>
\u00a0<\/h5>
5 – <\/span>The buyer is obliged to pay the price from the moment the online ordering procedure is completed. This happens when the buyer clicks the \u201cplace order\u201d button at the end of the guided procedure.<\/span><\/h5>

6 – <\/span>Once the contract has been concluded, the seller takes charge of the order for fulfilment.<\/span><\/h5>

Art. 4 \u2013 Registered users<\/span><\/h5>
\u00a0<\/h5>
1 – <\/span>When completing the registration procedure, the user undertakes to follow the instructions on the site and to provide his or her personal data correctly and truthfully.<\/span><\/h5>
\u00a0<\/h5>
2 – <\/span>Once registered, the user will receive a confirmation email at the email address provided. Confirmation must be given within 30 days at the latest. After this period, in the absence of confirmation, posa pro will be released from any obligation towards the user.<\/span><\/h5>
\u00a0<\/h5>
3 – <\/span>In any case, confirmation will release posa pro from all liability regarding the data provided by the user. The user undertakes to inform posa pro promptly of any change to the data provided at any time.<\/span><\/h5>
\u00a0<\/h5>
4 – <\/span>If the user provides inaccurate or incomplete data, or if the parties concerned dispute the payments made, posa pro may refrain from activating, or may suspend, the service until the relevant shortcomings have been remedied.<\/span><\/h5>
\u00a0<\/h5>
5 – <\/span>When the user first requests the activation of a profile, posa pro will assign a username and password. The user acknowledges that these credentials constitute the system for validating the user's access to the Services and the sole system suitable for identifying the user, and that acts performed through such access will be attributed to the user and will be binding on him or her.<\/span><\/h5>
\u00a0<\/h5>
6 – <\/span>The user undertakes to keep his or her access credentials secret, to look after them with due care and diligence and not to disclose them, even temporarily, to third parties.<\/span><\/h5>
\u00a0<\/h5>
Art. 5 \u2013 Product availability<\/span><\/h5>
\u00a0<\/h5>
1 – <\/span>Product availability refers to actual availability at the moment the buyer places the order. This availability must in any case be considered purely indicative because, as several users may be on the site at the same time, products may be sold to other customers before the order is confirmed.<\/span><\/h5>
\u00a0<\/h5>
2 – <\/span>Even after the order confirmation email has been sent, products may turn out to be partially or totally unavailable. In this case, the order will be automatically amended by removing the unavailable product and the buyer will be informed immediately by email.<\/span><\/h5>

3 – <\/span>If the buyer requests cancellation of the order, thereby terminating the contract, posa pro will refund the amount paid within 30 days from the moment posa pro became aware of the buyer's decision to terminate the contract.<\/span><\/h5>

Art. 7 \u2013 Payment methods and prices<\/span><\/h5>
\u00a0<\/h5>
1 – <\/span>The price of products will be the one shown on the site from time to time, except in the case of an obvious error.<\/span><\/h5>

2 – <\/span>In the event of an error, posa pro will notify the buyer as soon as possible, allowing the buyer to confirm the order at the correct price or to cancel it. In any case, posa pro will not be obliged to supply the goods sold at the lower price shown in error.<\/span><\/h5>

3 – <\/span>Prices on the site include VAT and do not include shipping costs. Prices may change at any time. Changes do not affect orders for which an order confirmation has already been sent.<\/span><\/h5>

4 – <\/span>Once selected, the desired products will be added to the cart. Simply follow the purchase instructions, entering or checking the information required at each step of the process. Order details can be changed before payment.<\/span><\/h5>

5 – <\/span>Payment can be made by: PayPal; bank transfer; cash on delivery.<\/span><\/h5>

Art. 8 \u2013 Delivery<\/span><\/h5>

1 – <\/span>Posa Pro ships throughout Italy, excluding Vatican City and the Republic of San Marino.<\/span><\/h5>

2 – <\/span>Posa Pro will only deliver to the user's address provided at the time of purchase.<\/span><\/h5>
\u00a0<\/h5>
3 – <\/span>Delivery is generally made within 15 working days or, if no delivery date is specified, within the estimated time given when the delivery method is selected and, in any case, within a maximum of thirty days from the date of confirmation.<\/span><\/h5>
\u00a0<\/h5>
4 – <\/span>If delivery is not possible, the order will be sent to the depot. In this case, a notice will specify where the order is located and how to arrange a new delivery.<\/span><\/h5>
\u00a0<\/h5>
5 – <\/span>If you are unable to be present at the delivery address at the agreed time, please contact us again to arrange a new delivery date.<\/span><\/h5>

6 – <\/span>If delivery cannot take place for reasons not attributable to us within thirty days of the date on which the order is available for delivery, we will assume that you wish to terminate the contract.<\/span><\/h5>

7 – <\/span>Following termination, the amounts paid will be refunded, including delivery costs but excluding any additional costs arising from the choice of a delivery method other than the standard method offered, without undue delay and in any case within 30 days of the date of termination of the contract. Transport resulting from the termination of the contract may involve additional costs, which will be borne by the buyer.<\/span><\/h5>

Art. 9 \u2013 Transfer of risk<\/span><\/h5>

1 – <\/span>The risks relating to the products pass to the buyer from the moment of delivery. Ownership of the products is deemed acquired once full payment of all amounts due in relation to them, including shipping costs, has been received, or at the moment of delivery if this occurs later.<\/span><\/h5>

Art. 10 \u2013 Warranty and conformity<\/span><\/h5>
\u00a0<\/h5>
1 – <\/span>The seller is liable for any defect in the products offered on the site, including any lack of conformity of the items with the products ordered, in accordance with Italian law.<\/span><\/h5>
\u00a0<\/h5>
2 –\u00a0<\/span>If the buyer entered into the contract as a consumer, i.e. any natural person acting on the site for purposes outside any business or professional activity he or she may carry out, this warranty is valid provided that the defect becomes apparent within 24 months of the date of delivery of the products; that the buyer submits a formal complaint about the defects within a maximum of 2 months from the date on which he or she discovered the defect; and that the online returns form is completed correctly.<\/span><\/h5>

3 – <\/span>In the event of lack of conformity, a buyer who entered into the contract as a consumer will be entitled to have the products brought into conformity free of charge, by repair or replacement, or to obtain an appropriate price reduction or the termination of the contract in respect of the disputed goods and the consequent refund of the price.<\/span><\/h5>

Art. 11 \u2013 Withdrawal<\/span><\/h5>
\u00a0<\/h5>
1 – <\/span>In accordance with the legal provisions in force, the buyer has the right to withdraw from the purchase without any penalty and without giving any reason within 14 days, pursuant to art. 57 of Legislative Decree 206\/2005, starting from the date of receipt of the products.<\/span><\/h5>
\u00a0<\/h5>
2 – <\/span>In the case of multiple purchases made by the buyer with a single order and delivered separately, the 30-day period runs from the date of receipt of the last product.<\/span><\/h5>
\u00a0<\/h5>
3 – <\/span>Users wishing to exercise their right of withdrawal may send an email, stating the order number and the user's name, to: <\/span>info@posapro.it.<\/span><\/a><\/h5>

4 – <\/span>The buyer may also exercise the right of withdrawal by sending any explicit statement setting out the decision to withdraw from the contract or, alternatively, by sending the standard withdrawal form set out in Annex I, part B, of Legislative Decree 21\/2014, which is not mandatory.<\/span><\/h5>

6 – <\/span>Goods must be returned intact, in their original packaging, complete in all their parts and with the accompanying tax documents. Subject to the right to check compliance with the above, the site will refund the amount of the products subject to withdrawal within a maximum of 30 days, including any shipping costs.<\/span><\/h5>

7 – <\/span>The right of withdrawal will not apply where posa pro's services and products fall within the categories of art. 59 of Legislative Decree 206\/2005.<\/span><\/h5>

8 – <\/span>The site will make the refund using the same payment method chosen by the buyer at the time of purchase. If payment was made by bank transfer and the buyer wishes to exercise the right of withdrawal, the buyer must provide the bank details (IBAN, SWIFT and BIC) needed to make the refund.<\/span><\/h5>

2 – <\/span>Any disputes arising from or in connection with them shall be settled exclusively by the Italian courts.
